Going through a divorce is difficult enough, but for some families the holidays present additional challenges when it comes to custody, even after the divorce or paternity proceedings have concluded. Some families have the ability to be flexible and can simply reach an agreement between themselves each holiday. Most families with minor children, however, must rely on a written agreement which details a holiday schedule specifically tailored to their family’s needs. The schedule can be set, such that a parent has the same holiday each year, can alternate annually, or a holiday can be shared, depending on each family’s circumstances. Parents going through the divorce process can seek to have a holiday schedule established by way of a temporary order of the Court so that there is no confusion or disagreement over the schedule during the divorce proceedings. The temporary order can include an agreement of the parties, referred to as a “stipulation,” detailing the holiday schedule, which they jointly submit to the Court to become a Court order. When the parties cannot reach an agreement, either party can file a motion to be heard by the Court, asking the judge to order a specific schedule.
